of the publisher Dr. Jan Sojka, place of business and delivery address Zahradní 15, 783 35 Horka nad Moravou, Czech Republic, company registration number 73162086, VAT number CZ7608195408, for the sale of goods through the online shop at www.psittaculture.eu (the „Seller”).

Contact: info@psittaculture.eu, sales@psittaculture.eu, +420 739 009 276.

1. Introductory provisions

1.1 These terms and conditions govern the mutual rights and obligations of the parties arising from a purchase contract concluded between the Seller and the Buyer through the Seller’s online shop.

1.2 A consumer is a natural person who enters into a contract with the Seller outside the scope of their business activity. Provisions marked as applying to consumers do not apply to buyers who purchase in the course of their business or profession.

1.3 Terms individually agreed in the contract prevail over these terms and conditions.

1.4 These terms and conditions form an integral part of the contract. The contract is concluded in the English language.

1.5 The Seller may amend these terms and conditions. The version in force on the day the contract is concluded applies to that contract.

2. User account

2.1 The Buyer may order with or without registration.

2.2 The Buyer must provide true and accurate information and keep it up to date.

2.3 Access to the account is protected by a username and password, which the Buyer must keep confidential and must not share with third parties.

2.4 The Seller may cancel an account, in particular where the Buyer has not used it for more than 12 months or has breached obligations under the contract.

2.5 The account may be temporarily unavailable, in particular due to necessary maintenance.

3. Conclusion of the contract

3.1 The presentation of goods in the online shop is for information only and does not constitute a binding offer.

3.2 Prices are shown inclusive of value added tax where applicable. Shipping costs are shown with the goods and in the order form and are not included in the price of the goods. Prices are valid for as long as they are displayed in the online shop.

3.3 For deliveries outside the European Union, customs duties, import taxes and handling fees may apply in the country of destination. These are payable by the Buyer and are not included in the price or in the shipping cost.

3.4 The Buyer places an order by completing the order form. Before submitting the order the Buyer may check and change the data entered. The order is submitted by clicking the order button, which indicates an obligation to pay.

3.5 The Seller confirms receipt of the order without delay by e-mail. The contract is concluded when the Seller’s acceptance of the order is delivered to the Buyer’s e-mail address.

3.6 The Seller may ask the Buyer to confirm the order additionally, for example in writing or by telephone.

3.7 The Buyer bears the cost of using means of distance communication; those costs do not differ from the basic rate.

4. Price and payment

4.1 The Buyer may pay the price and the shipping cost by payment card, by PayPal, or by bank transfer to the account stated in the order confirmation.

4.2 Together with the price, the Buyer pays the agreed packaging and delivery costs.

4.3 Where payment is made by bank transfer, the price is due within 7 days of conclusion of the contract. The Buyer’s obligation is discharged when the amount is credited to the Seller’s account.

4.4 The Seller may require payment of the full price before the goods are dispatched.

4.5 Discounts cannot be combined unless expressly stated otherwise.

4.6 Where the Seller announces a price reduction, it also states the lowest price at which the goods were offered during the 30 days before the reduction was applied.

4.7 The Seller issues an invoice after the price has been paid and sends it electronically to the Buyer’s e-mail address.

5. Right to withdraw from the contract

5.1 A Buyer who is a consumer has the right to withdraw from the contract within fourteen (14) days of taking delivery of the goods without giving any reason. Where the contract covers several items delivered separately, the period runs from delivery of the last item.

5.2 The right to withdraw does not apply, among others, to the supply of goods made to the Buyer’s specification, goods liable to deteriorate rapidly, goods which after delivery are inseparably mixed with other items, goods in a sealed package which the consumer has removed from the packaging and which cannot be returned for reasons of hygiene, and to a sound or video recording or computer software supplied in a sealed package if the package has been opened. The supply of newspapers, periodicals or magazines is also excluded, except for subscription contracts.

5.3 To withdraw, the Buyer sends a clear statement to Dr. Jan Sojka, Zahradní 15, 783 35 Horka nad Moravou, Czech Republic, or to info@psittaculture.eu. The model withdrawal form annexed to these terms may be used.

5.4 The Buyer returns the goods within fourteen (14) days of withdrawal. The Buyer bears the direct cost of returning the goods, including any cost of return from outside the European Union.

5.5 The Seller refunds all payments received, including the standard cost of delivery, within fourteen (14) days of receiving the withdrawal, using the same means of payment the Buyer used, unless the Buyer agrees otherwise and no additional cost arises for the Buyer. The Seller may withhold the refund until the goods have been received or until the Buyer proves that they have been sent back.

5.6 The Seller may set off any claim for damage to the returned goods against the Buyer’s claim for a refund.

5.7 If a gift was supplied with the goods, the gift agreement ceases to be effective upon withdrawal and the Buyer returns the gift together with the goods.

6. Delivery

6.1 The Seller dispatches goods worldwide. Delivery times depend on the destination and on the postal or courier service used.

6.2 The Buyer must take delivery of the goods.

6.3 Where repeated delivery or delivery by other means becomes necessary for reasons on the Buyer’s side, the Buyer bears the resulting costs.

6.4 On receipt from the carrier the Buyer checks that the packaging is intact and reports any damage to the carrier without delay.

7. Defective goods

7.1 The Seller is liable to the Buyer for the goods being free from defects on delivery, in particular that they correspond to the agreed description, type and quantity, are fit for the usual purpose and are supplied with the usual accessories.

7.2 Where a defect becomes apparent within one year of delivery, the goods are presumed to have been defective on delivery, unless the nature of the goods or of the defect precludes this (Section 2161(5) of the Czech Civil Code).

7.3 The Buyer may notify a defect which becomes apparent within two years of delivery (Section 2165 of the Czech Civil Code).

7.4 Claims are made at info@psittaculture.eu or in writing at the Seller’s address.

7.5 The Seller handles the claim and informs the Buyer of the outcome no later than 30 days after the claim is made, unless a longer period is agreed. Handling a claim is free of charge.

7.6 Clause 7.1 does not apply to goods sold at a reduced price in respect of the defect for which the price was reduced, to wear and tear caused by normal use, or, in the case of used goods, to a defect corresponding to the degree of use.

7.7 Buyers who are consumers resident in a European Union Member State retain the protection afforded to them by the mandatory provisions of the law of their country of habitual residence. Where those provisions grant longer periods or additional rights, they prevail over clauses 7.2 and 7.3.

8. Other rights and obligations

8.1 The Buyer acquires ownership of the goods upon payment of the full price.

8.2 The Seller is not bound by any code of conduct in relation to the Buyer.

8.3 Complaints are handled through info@psittaculture.eu and the outcome is communicated to the Buyer’s e-mail address.

8.4 The Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Prague 2, Czech Republic, adr.coi.cz, is competent for the out-of-court settlement of consumer disputes.

8.5 Consumers resident in another European Union Member State may also contact the European Consumer Centre in their country. The European Online Dispute Resolution platform ceased to operate on 20 July 2025 and is no longer available.

8.6 The Seller trades on the basis of a Czech trade licence. Supervision is exercised by the competent trade licensing office, by the Czech Trade Inspection Authority and, in matters of personal data, by the Office for Personal Data Protection.

9. Personal data

9.1 The Seller meets its information obligation under Article 13 of Regulation (EU) 2016/679 (GDPR) through a separate document, Privacy Policy.

10. Commercial communications and cookies

10.1 The Seller sends commercial communications to the Buyer’s e-mail address either with the Buyer’s consent or in connection with a previous purchase. The Buyer may opt out at any time and free of charge, using the link in every message or by writing to info@psittaculture.eu.

10.2 The Seller’s website does not use third-party cookies or any tracking tool that would require consent to the storage of cookies. Only technical files necessary for the operation of the site and the shopping basket are used.

11. Delivery of communications and final provisions

11.1 Communications may be delivered to the Buyer’s e-mail address.

11.2 The contract is governed by Czech law. This choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.

11.3 If any provision is or becomes invalid or ineffective, it is replaced by a provision whose meaning is as close as possible to it. The validity of the remaining provisions is not affected.

11.4 The contract together with these terms and conditions is archived by the Seller in electronic form and is not accessible to third parties.

11.5 The model withdrawal form is annexed to these terms and conditions.
